How Is Property Divided in a Washington Divorce?

Washington is a community property state, which means most property acquired during the marriage belongs to both spouses.

However, courts do not always divide property 50/50. Instead, judges divide property in a way that is “just and equitable.”

The court may consider:

  • Length of the marriage

  • Each spouse’s financial situation

  • Separate vs. community property

  • Future financial needs

A court may award more property to one spouse if fairness requires it.
